| Children’s Online Privacy Protection Act: A Summary Posted: 03 Sep 2008 09:04 AM PDT The primary goal of the Children's Online Privacy Protection Act (COPPA) Rule is to give parents control over what information is collected from their children online and how such information may be used. The Rule applies to: Operators of commercial Web sites and online services directed to children under 13 that collect personal information from them; Operators of general audience sites that have a separate children's area and that collect personal information from children under 13. The Rule requires operators to: Post a privacy policy on the homepage of the Web site and link to the privacy policy on every page where personal information is collected. Provide notice about the site's information collection practices to parents and obtain verifiable parental consent before collecting personal information from children. Give parents a choice as to whether their child's personal information will be disclosed to third parties. Provide parents access to their child's personal information and the opportunity to delete the child's personal information and opt-out of future collection or use of the information. Not condition a child's participation in a game, contest or other activity on the child's disclosing more personal information than is reasonably necessary to participate in that activity. Maintain the confidentiality, security and integrity of personal information collected from children. In order to encourage active industry self-regulation, COPPA also includes a safe harbor provision allowing industry groups and others to request Commission approval of self-regulatory guidelines to govern participating Web sites' compliance with the Rule. To elaborate on what has already become a dominant factor in today’s news, Sarah Palin, Governor of Alaska, has been recently nominated by Senator John McCain to be his Vice President. Upon accepting the nomination, the press came to find (amongst other things) that Palin’s youngest son has Down syndrome and her 17-year old daughter is pregnant. Initial questions have been raised with regard to her ability to juggle a family of 5, while sitting in a post that could (if the 72 year old McCain were, unfortunately, to become incapacitated) render her as President of the United States. 1. Whether or not her personal life (i.e., the demands of her family responsibilities and whether she views them as more important than her responsibilities to the country, or anything to do with her pregnant daughter) is any business of the press. 2. Whether or not Gov. Palin, insofar as she seeks to hold one (of only two) positions in the Executive branch of government, should be given any more leniency with regard to her personal matters than that which was given to former President Clinton when he was attacked for cheating with Monica Lewinsky? 3. Can anyone who has a family life that is, let’s say, “less than flattering” still be counted on to govern effectively?? Or, does one’s effectiveness in one role (i.e., as a mother/ father/ wife/ husband) determine one’s effectiveness in the other (i.e., as a President/ Vice President)? 4. Does the controversy surrounding Gov. Palin’s background reflect poorly on Sen. McCain’s judgment, or did he wholly intend to play the gender card while steering public opinion in the direction of further questioning her background and raising issues of moral judgements? 5. Does the Republican VP nominee’s (Sarah Palin’s) unwed pregnant daughter call a halt to moral judgements from the Right? 6. If Democratic party leaders have declared family matters “off limits,” what do we (the press or the public) hope to gain by subjecting Gov. Palin and her family to further public scrutiny?
Indeed, Gov. Palin’s nomination appears to have raised more questions than it has answered. And, while Sens. Obama and Biden have publicly chosen to ignore any/ all personal matters and stay focused on the issues, others seem to have found these issues too spicey to ignore. While she has publicly announced that her unmarried 17-year-old daughter, Bristol Palin, was pregnant, there have been other revelations: * A private attorney has been authorized to spend $95,000 of state money to defend her against accusations of abuse of power. * Palin has sought pork-barrel projects for her city and state — contrary to her reformist image. * Her husband once belonged to a fringe political group in Alaska, with some members supporting secession from the United States. * She has acknowledged smoking marijuana in the past. * She is no replacement for Hillary Clinton, though McCain denies he chose Palin to capture those disenchanted by Clinton’s loss to Obama. None of these revelations, however, seem to have shaken McCain’s confidence or undermined her support among GOP delegates. Understandably, the overriding objective of the press is to sell television time and/ or newspapers — not to facilitate dialogue in the public interest. Doing so means digging up any/ everything that has dramatic effect. In the end, it will be particularly interesting how the American public processes the above questions. Indeed, it will be interesting whether they decide to engage these questions at all. But, whether they do or do not, they certainly appear relevant not only to our current state of affairs, but apparently to our political lives in general. Question #3, in particular, is and has remained one of the most fundamental questions in the entire field of Political Science and Public Affairs since the middle ages . . . and, it has vastly different implications for society depending on how (or whether) they directly answer it. For instance, the American public seems to have ignored its humungous implications back when President Clinton was being railed about his affair with Monica Lewinsky. Their answer, at that time, was that in order to be a “good” public leader, you had to be a “good” private leader (i.e., in your own family), and that any questionable activity in your role as a family leader implied similar questions regarding your ability to govern as a public leader — despite the fact that, at that same time, our economy produced a sizeable surplus, gasoline was relatively cheap, and we were not spending $10 billion/ month to conduct two wars in (unappreciative?) countries that would rather we left them alone. Addressing the question head-on would be the more responsible approach, both from the standpoint of what we might expect when governing public policy and/ or electing our public officials. But, by suggesting that questions about Gov. Palin’s background and/ or that of her family should be “off limits,” that she’s no different from the rest of us, and that we shouldn’t look at her private life as a reflection of her governing ability, Sen. McCain places himself in the precarious position of undermining arguments from the Republican Right which (particularly in the attempted? impeachment of President Clinton) have held just the opposite. Moral judgements aside, the question needs to be settled. I am personally of the opinion that our society is not the same as it was in the classic political days of Plato’s Republic; life is, without question, more complicated. Our roles are more complicated and we have a whole lot more of them than in Plato’s days. While it made sense, in those days, to judge a public official by how well she/ he handled their private affairs — it makes little sense today. In fact, by doing so, I believe we not only miss the complexity of modern life, we bypass (what would be, and to our loss) some of the most effective public leaders of our time. No one’s perfect. Not you. Not me. Not Palin. Not Clinton. Not McCain. Not Obama. The same applies even moreso to our families, or extended families. “Let he who is without sin cast the first stone . . .” While none of us are perfect, that should not deter us from seeking which public leaders are, otherwise, as competent as possible, and it should not deter us from giving them the space needed to govern our affairs without being forced to defend everything they or their family members have done in the past. Yes, moral standards are important and we should hold our elected officials to standards that are noticeably higher than the legal limit, but if we are intelligent/ sophisticated enough to do so, we should also be intelligent/ sophisticated enough to distinguish between “being human” and just plain old “trying to get rid of the guy/ gal you didn’t vote for.” Obama/ Biden have chosen not to construe personal attacks against the opposition or their family members. At some point, we need to do likewise and concern ourselves less with questions of which candidate’s family is “picture perfect,” or of which candidate is more deserving of personal privacy. We have MAJOR issues at stake: the mortgage, debt, and real estate crises in the U.S. are not over, not by a long shot; much of our nation’s financial structure is collapsing, and our government’s only response thusfar has been phony money, bogus bailouts and a litany of false promises; the Federal Reserve Bank is, no doubt, in “bailout mode” (look at the obvious Bear Stearns backstop a couple months ago and now the Fannie/Freddie fiasco); and, who knows how many other firms the Fed has saved — so far — by opening up the vault doors to nearly everyone. On top of that, we’re at least 70% dependent on foreign nations for oil energy and are at war with two nations, costing us upwards of $10 billion/ every month. This in mind, and certainly there are other equally important issues at stake, it would appear that we have much more weighty problems at hand — suggesting we look very closely, not at which candidate has the cleanest hands or the cleanest underwear, but which one seems best equipped and is most inclined to turn our society around and get us (i.e., all of us, not just those of us who vote) back on its feet. No one else can do this for us.
